Restaurant Publisher Terms
These terms govern the relationship between the operator of seemykitchen.live (“we”, “us”, “the Platform”) and a food business that lists a kitchen and streams it (“you”, “the Restaurant”). By creating an account, submitting an application, or streaming to us, you accept them. If you are accepting on behalf of a business, you confirm you are authorised to bind it.
1. What we are, and what we are not
1.1 You are the publisher of your video and listing content. We are a technical intermediary that transmits it. We do not create, select, direct, edit, curate the content of, or verify your video, and we do not control what your camera points at.
1.2 We are not a food business, a food aggregator, a delivery service, a payment processor for your orders, or a food-safety certifier. We do not inspect your premises. Any hygiene score, licence number or audit date displayed is information you supplied or that we reproduced from a public register, and you are responsible for its accuracy and currency.
1.3 Nothing is recorded. Video passes through memory and is overwritten within seconds. There is no archive. This means we cannot, and will never be able to, supply footage to you, to your insurer, to a customer, to your staff, or to any authority — including in response to a legal demand. If you need recorded footage for any purpose, you must record it yourself on your own equipment.
2. Your content, and what is prohibited
2.1 You may stream only the food-preparation area of the premises named in your listing, from the camera position agreed at onboarding. Pointing a camera at anything else — including any other part of the premises, a public area, a street, a residence, or another business — is a material breach.
2.2 You must not transmit, display, or allow within camera view:
- any obscene, indecent, sexually explicit, pornographic or nudity-containing material;
- any content depicting or involving a minor in any sexual, exploitative or unlawful context;
- violence, cruelty to animals beyond lawful food preparation, weapons, self-harm, or content glorifying any of them;
- illegal drugs or drug paraphernalia, unlawful gambling, or the sale of any prohibited substance or item;
- any third-party copyrighted work, including films, television broadcasts, sporting events, music videos, or streamed content — whether played on a screen visible to the camera or otherwise. A television, monitor or phone screen showing such content must not be in frame;
- hate speech, slurs, or material targeting any person or group on the basis of religion, caste, race, sex, gender, disability, sexual orientation or place of birth;
- political campaigning, religious proselytising, advertising for any other business, or any content unrelated to the genuine operation of your kitchen;
- anything unlawful under the laws of India, including the Bharatiya Nyaya Sanhita, the Information Technology Act 2000, and the rules made under them.
2.3 Your listing text and images— business name, tagline, description, offers, photographs and camera labels — must not contain profanity, obscenity, slurs, sexual content, another business's trademark or branding, false or misleading claims about food, health, hygiene or licensing, or any personal data of a third party.
2.4 The stream must show your kitchen genuinely operating. You must not substitute recorded, looped, simulated, or third-party footage; point the camera at a different kitchen; or otherwise misrepresent what is being shown. Doing so is fraud against the diners the Platform exists to inform, and is grounds for immediate and permanent removal.
2.5 You must not use the stream as a general-purpose broadcasting channel for anything other than your kitchen.
3. Staff, consent and privacy
3.1 You warrant that you have obtained, and retain on file, written consent from every member of staff who may appear in the stream, and that you have displayed the kitchen signage we provide in a position visible to them.
3.2 You are the Data Fiduciary in respect of your staff and any other person appearing in your stream, for the purposes of the Digital Personal Data Protection Act 2023. You are responsible for the lawful basis of that processing, for honouring their rights, and for responding to their requests and complaints. Our not retaining footage does not transfer or reduce that responsibility.
3.3 You must position the camera so that faces are not readily identifiable — over a tandoor, tawa, handi or pass rather than at head height across a room. If a member of staff withdraws consent, you must reposition the camera or take the feed offline.
3.4 No audio is captured at any point in the system. You must not attempt to transmit audio, and you must not represent to anyone that audio is being captured.
4. Licences and compliance
4.1 You warrant that you hold a valid FSSAI licence or registration and every other licence, permission and consent required to operate, and that the details you give us are true, complete and current. You must notify us within 7 days if any licence is suspended, cancelled, expires or is not renewed.
4.2 We display licence and expiry information as given, including when it has expired. We will not conceal an expired licence at your request — suppressing it would defeat the only purpose the Platform serves.
4.3 You remain solely responsible for compliance with the Food Safety and Standards Act 2006, applicable labour and shop-establishment laws, local trade licensing, and tax obligations.
5. Your account and credentials
5.1 Your account is personal to the authorised signatory of the Restaurant. Sign-in links are sent to your registered email address and are the equivalent of a key to your account.
5.2 You are responsible for every action taken through your account, whether by you, an employee, a contractor, a family member, an agency, or anyone who obtains access — with or without your permission. Activity through your account is treated as yours.
5.3 You must keep your registered email account secure, must not share sign-in links, must not allow staff or third parties to use your account, and must not create an account on behalf of another business without written authority from it.
5.4 You must notify us at seemykitchenlive@gmail.com immediately on becoming aware of any unauthorised access, and you remain liable for activity occurring before that notice reaches us.
5.5 The Platform is provided for the single purpose of publishing a live view of your own kitchen to prospective diners. Any other use — including automated access, scraping, resale, embedding our streams elsewhere, load testing, attempting to reach another restaurant's data, or circumventing playback authorisation — is prohibited.
6. Indemnity
6.1 You will indemnify, defend and hold harmless us and our operators, officers, employees and contractors against all claims, proceedings, demands, fines, penalties, losses, damages and reasonable legal costs arising out of or in connection with:
- your video, listing content, images or text;
- any claim by a member of your staff, a customer, a visitor, a neighbour or any third party relating to your stream or premises;
- any inaccuracy in the licence, hygiene, pricing or other information you supplied;
- any breach by you of these terms or of any applicable law, including food safety, data protection, labour and copyright law;
- any activity conducted through your account.
6.2 This indemnity survives termination and is not limited by clause 8.
7. Our rights of suspension and removal
7.1 We may remove your stream or listing, or suspend your account, immediately and without prior notice, where we reasonably believe there has been a breach of clause 2, 3, 4 or 5, where we receive a credible complaint, where required by law or a competent authority, or where continuing would expose us to legal risk.
7.2 We are under no obligation to monitor streams or listings, and we do not warrant that we will detect any breach. Not detecting something does not waive our rights or imply approval.
7.3 Removal for breach does not entitle you to a refund of fees for the period in which the breach occurred.
7.4 You may take your kitchen offline at any time using the control in your dashboard, and may cancel with effect from the end of the current billing month.
8. Service, availability and liability
8.1 The Platform is provided “as is”. We do not warrant uninterrupted or error-free availability. Streams depend on your recorder, your camera, your internet connection and your electricity supply — none of which are within our control.
8.2 We are not liable for lost sales, lost profits, lost goodwill, reputational harm, or any indirect, special or consequential loss, however arising.
8.3 Our total aggregate liability to you, in contract, tort (including negligence) or otherwise, is limited to the total subscription fees actually paid by you in the three months immediately preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.
8.4 Anyone watching can screen-record. We cannot prevent a viewer from capturing, sharing or reposting what your camera shows, and we accept no responsibility for their doing so. If that risk is unacceptable to you, do not stream. Your offline control exists for exactly this reason.
9. Fees
9.1 Subscription fees are payable monthly in advance per kitchen, are exclusive of applicable taxes, and are not refundable for part months.
9.2 We may change fees on 30 days' notice. Continuing to use the Platform after that date is acceptance of the new fee.
9.3 We may suspend a stream where fees are more than 14 days overdue.
9.4 Promoted placement. Where you pay for increased prominence, that placement will be visibly labelled as promoted. We will not present paid placement as an organic or editorial ranking.
10. Equipment
10.1 Any hardware we lend or install remains our property. You must return it, in working order, within 14 days of cancellation, and you are responsible for its loss or damage while on your premises.
10.2 You are responsible for your own cameras, recorders and network, and for ensuring our use of them does not breach any agreement you have with a third-party security provider.
11. Complaints and takedown
11.1 Grievance Officer contact: seemykitchenlive@gmail.com. We acknowledge complaints within 24 hours and aim to resolve them within 15 days, in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021.
11.2 On notice of unlawful content, we will act to disable access within 36 hours.
11.3 If we receive a complaint about your stream or listing, you must cooperate with our enquiries and respond within 48 hours.
12. General
12.1 We may vary these terms on 15 days' notice to your registered email. Continued use after that date is acceptance. We record which version you accepted and when.
12.2 These terms are governed by the laws of India, and the courts at Hyderabad, Telangana have exclusive jurisdiction.
12.3 If any provision is held unenforceable, the remainder continues in force.
12.4 Nothing here creates a partnership, joint venture, franchise, agency or employment relationship between us.
